The subject of this document is to provide the user with an online platform that presents the activities of TĂȘULEASA SOCIAL ASSOCIATION within the Via Transilvanica project.
DEFINITIONS
- "Platform"means the interactive online platform that allows the User to view the services of TĂȘULEASA SOCIAL ASSOCIATION.
- "Confidential Information"means any information relating to the User or the Provider, their associates and affiliates, or this Contract, made available either before or after the signing date.
- "User" or "Customer"means the natural person who accesses the Platform and/or places an Order for the purchase of the Services offered by the Provider.
- "GDPR"means REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation).
- "Newsletter"means the service for receiving electronic notifications by email, based on the user consent.
ELIGIBILITY

The following information is not considered Confidential Information:
- is or has become public (including, without limitation, any information submitted to any governmental agency and available to the public) otherwise than through disclosure by TĂȘULEASA SOCIAL ASSOCIATION in breach of this section
- is made available to TĂȘULEASA SOCIAL ASSOCIATION on a non-confidential basis from a source other than the User which TĂȘULEASA SOCIAL ASSOCIATION believes is not prohibited from disclosing such information to the Provider
- is known to TĂȘULEASA SOCIAL ASSOCIATION before being received from the User without any confidentiality obligation
- is developed by TĂȘULEASA SOCIAL ASSOCIATION independently of the Confidential Information disclosed by the User
The User will not disclose to any third party the Confidential Information received from TĂȘULEASA SOCIAL ASSOCIATION except under the conditions set out in these Terms and Conditions and unless required by applicable law.
NOTICES
The User agrees that all communications made under this document will take place by email at the address communicated by the User through the Platform, consenting that such communication is valid by simple proof from the Provider that the communication was sent. TĂȘULEASA SOCIAL ASSOCIATION has the right to use other transmission methods (by post, courier, or bailiff) for its communications to the User.
The parties agree that all communications related to this document will be made to the following addresses:

INTELLECTUAL PROPERTY
The entire content of the platform is the intellectual property of TĂȘULEASA SOCIAL ASSOCIATION. The platform will be used by users only for correspondence with TĂȘULEASA SOCIAL ASSOCIATION.
Users of the platform do not have the right to download, partially or entirely modify the site, partially or entirely reproduce the site, copy, distribute, sell, or exploit the site in any other manner contrary to the interests of TĂȘULEASA SOCIAL ASSOCIATION, regardless of whether there is a commercial purpose.
Any content (including but not limited to visual elements, databases, graphic elements, trademarks, legal content) is the intellectual property of TĂȘULEASA SOCIAL ASSOCIATION. The entire site is protected by Law no. 8/1996 on copyright and related rights, and for any infringement of intellectual property, TĂȘULEASA SOCIAL ASSOCIATION reserves the right to notify the competent courts for full recovery of damages, as well as to file a criminal complaint with judicial authorities for the criminal liability of the perpetrator.
APPLICABLE LAW. DISPUTES
This agreement, as well as any use of the platform, will be governed by Romanian law. The parties will attempt to resolve any disagreement amicably; otherwise, disputes will be resolved by the competent Romanian courts according to law.
